Softball Training Academy LLC, operates SoftballTrainingAcademy.com, which is an athletic training facility used primarily by Gametime Stars Fastpitch Softball Club. Softball Training Academy.com allows users, or "fans," the ability to create profiles for the purposes of communicating with other fans. The Softball Training Academy services are hosted in the United States.

By accessing or using the services of Softball Training Academy, you agree to the Terms of Use outlined below, also referred to as the “Agreement.” In order to be authorized to use the Softball Training Academy services, you must agree to follow all laws, rules, regulations, and the terms set forth in this Agreement, and opt-in that you have read the Terms of Use at the point of registration. Softball Training Academy reserves the right to update the Terms of Use periodically. All members will be notified of any changes. Your continued use of the site will constitute agreement of the revised Terms of Use.

Your safety
Upon joining Softball Training Academy, you will be prompted to select an account password. You agree that you are responsible for your account, and will not disclose your password, or use the password of another member. If you suspect fraudulent activity on the account, you agree to notify Softball Training Academy immediately. If you are under the age of 18, you agree not to create a Softball Training Academy account.

Account Security
You will not create an account for another person without permission. You agree not to share you password with others, or let other people use your account. We reserve the right to reclaim any usernames if they contain prohibited content, offensive language, or pose trademark issues. You agree your Softball Training Academy account is for the purposes of discussing sports (professional, amateur, or personal) and that you will not use your account for commercial or monetary gain.

Use by members
Your Softball Training Academy account may not be used to promote products or services that are not specifically endorsed by Softball Training Academy. You agree that Softball Training Academy is not a platform to promote other products and services. Content such as commercial advertisements, affiliate links, and other unauthorized data collection or solicitation will result in the removal of the subject matter, and potential termination of the account. The use of third party promotion sites or software is strictly prohibited.

Prohibited Content/Member Conduct
Content containing any of the following is prohibited and will be removed, and the account will be subject to termination:
• Spam, or any other unsolicited mailing to fans
• Promotes or encourages gambling
• Promotes or encourages illegal activity or behavior
• Contains nudity, promotes pornography, or other offensive subject matter
• Unauthorized collection of fan information
• Contains viruses, worms, bots, code, files, or programs that disrupt the functionality of the network, or provide unauthorized access
• Intimidate, threaten, harass, or stalk other users
• Violates privacy rights, copyrights, trademark rights, or any other rights of another person
• Photograph(s) or video(s) containing other people, without the consent of that person or persons
• Any behavior that creates legal or reputational risk for Softball Training Academy
• Contains advertisements or solicitations for users to purchase or sell products or services.

Your Photos You agree that Softball Training Academy may resize files at our discretion to meet our website parameters. (For example, if you upload a photo with an excessive file size, we may resize the file, which may cause the photo to appear less clear.) Additionally, you agree not to upload team logos, photos of celebrities and athletes. Photos that contain pornographic, offensive, hateful, or violent content are strictly prohibited. Additionally, photos impersonating others may not be uploaded. You agree that you will not post any copyrighted photos without written permission from the photographer. If photos containing any of the content listed above are uploaded, we reserve the right to refuse the photo upload or remove the photo and your account may be terminated.

Copyright In using Softball Training Academy, you agree to honor the intellectual property of others. You agree not to upload, embed, post, email, or otherwise make available any material that infringes upon any copyright, patent, trademark, or other proprietary rights of any other party. Violation of this policy will result in the immediate removal of the material, and potential termination of the account.

Disputes You agree that you are responsible for any and all interactions you have on Softball Training Academy. We reserve the right to become involved, if we so choose, but are under no obligation to be come involved. This Agreement shall be governed by the laws of Nevada. You agree to submit to the jurisdiction of the Nevada courts to resolve any disputes.

Additionally, Softball Training Academy can offer no guarantees as to the accuracy of the content posted. Softball Training Academy is not responsible for the opinions expressed by members and takes no responsibility for any third party advertisements posted on Softball Training Academy. The services offered by Softball Training Academy are provided “as is” and “as available.”

Limitation on liability IN NO CIRCUMSTANCE SHALL Softball Training Academy BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF Softball Training Academy SERVICES. Softball Training Academy’S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARLESS OF THE FORM OF THE ACTION, WILL BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO Softball Training Academy FOR THE Softball Training Academy SERVICES DURING YOUR Softball Training Academy MEMBERSHIP PERIOD.

Indemnification IN THE EVENT THAT A PARTY BRINGS A CLAIM AGAINST STA ARISING FROM YOUR USE OF Softball Training Academy, YOU AGREE TO INDEMNIFY AND HOLD Softball Training Academy, OUR AFFLITIATES, SUBCONTRACTORS, AN OTHER PARTNERS, AND THEIR RESPECTIVE OFFICERS, AGENTS, PARTNERS AND EMPLOYEES HARMLESS FROM AND AGAINST ALL DAMAGES, LOSSES, AND EXPENSES OF ANY KIND (INCLUDING LEGAL FEES AND COSTS) RELATED TO THE CLAIM.

Other If any portion of these Terms of Use are deemed unenforceable, it will have no bearing on the remainder of the Agreement, which will remain full force and effect. In the event that this fail to enforce any aspect of this Agreement, it will not be considered a waiver. We reserve the right to make periodic amendments to this Agreement. You agree not to use any Softball Training Academy trademark (including STA) without our written permission.
